Terms & Conditions

These Terms & Conditions apply to all purchases, deliveries, installations, rentals, and services provided by Buoyant Bloom. Throughout these Terms, “Buoyant Bloom,” “we,” “us,” and “our” refer to Buoyant Bloom. “Client,” “customer,” “you,” and “your” refer to the individual or organization placing the order.

By placing an order, submitting payment, or accepting delivery, you confirm that you have reviewed and agreed to these Terms & Conditions.

1. Services

Buoyant Bloom provides custom balloon decor in Nashville, Tennessee, and select surrounding areas. Current offerings may include:

  • Balloon columns

  • Crazy balloon towers

  • Balloon photo frames

  • Classic balloon arches

  • Freestanding balloon garlands

  • Personalized 3-foot jumbo helium balloons

  • Available personalization and decorative add-ons

Buoyant Bloom operates through a product-based shop. Clients select from the products and customization options currently listed on the website.

Large-scale hanging installations, ceiling installations, balloon walls, and completely custom designs outside the listed product collection are not included unless expressly agreed to in writing.

2. Order Acceptance and Event-Date Reservation

Submitting an order does not guarantee acceptance or availability.

An order is considered accepted when:

  1. The required payment has been successfully processed;

  2. Buoyant Bloom has reviewed the order information; and

  3. The order or event date has been confirmed.

Your date is not reserved until the order has been accepted and payment has been received.

Buoyant Bloom may decline or cancel an order because of scheduling conflicts, unavailable materials, incomplete information, an address outside the service area, unsafe conditions, or a request that falls outside the services currently offered.

If Buoyant Bloom declines an order before production begins, any amount paid for that order will be refunded.

3. Client Information

The client is responsible for providing complete and accurate information, including:

  • Full name and contact information

  • Event date and time

  • Delivery and retrieval address

  • Venue name

  • On-site contact information

  • Delivery and setup instructions

  • Venue restrictions

  • Requested colors

  • Personalization wording

  • Logo information

  • Any known access limitations

Buoyant Bloom is not responsible for problems, delays, or additional expenses caused by incorrect, incomplete, or outdated information submitted by the client.

4. Pricing and Payment

All prices are listed in United States dollars.

Full payment is generally required when an order is placed unless Buoyant Bloom provides a different payment arrangement in writing.

Applicable sales tax, delivery fees, travel charges, venue access expenses, parking fees, rush fees, additional labor, and approved order changes may be added to the order total.

Any additional balance must be paid before delivery or installation. Buoyant Bloom may withhold delivery or setup if an outstanding balance remains unpaid.

Prices may change without notice. However, an accepted and fully paid order will not be affected by later general price changes unless the client requests modifications.

5. Delivery, Setup, and Equipment Retrieval Fee

Buoyant Bloom is a delivery-based balloon decor service. Customer pickup is not currently available for rental-supported decor.

The standard delivery, basic setup, and equipment retrieval fee starts at $75 within the approved service area.

The standard fee generally covers:

  • One scheduled delivery trip

  • Unloading of the balloon decor and equipment

  • Basic placement or setup

  • One scheduled return trip

  • Retrieval of Buoyant Bloom bases, poles, frames, stands, weights, and support equipment

Additional charges may apply for:

  • Locations outside the standard service area

  • Extended driving distance

  • Multiple delivery or retrieval locations

  • Paid parking or tolls

  • Difficult loading access

  • Stairs or limited elevator access

  • Long-distance carrying

  • Multiple setup areas

  • Venue-mandated scheduling

  • Excessive waiting

  • After-hours retrieval

  • Additional delivery or retrieval attempts

  • Setup requirements beyond those included with the product

Additional expenses caused by the venue or delivery location are the client’s responsibility.

6. Service Area and Availability

Standard service is available within approximately 20 miles of Nashville city center, subject to address approval.

Website checkout availability does not automatically guarantee that a requested delivery date or time can be accommodated.

7. Delivery and Setup Access

The client must ensure that Buoyant Bloom has safe, timely, and reasonable access to the venue.

Before the scheduled arrival time, the client must provide:

  • A correct delivery address

  • A working telephone number

  • An available on-site contact

  • Venue entry instructions

  • Loading and unloading instructions

  • Parking information

  • Elevator or stair information

  • Access to the designated setup area

  • Any required venue approval

The setup area must be clean, clear, accessible, and ready when Buoyant Bloom arrives.

If access is delayed, unavailable, restricted, or unsafe, Buoyant Bloom may:

  • Modify the setup;

  • Place the decor in an alternate approved location;

  • Leave the order with the client or venue contact;

  • Charge an additional waiting or return-trip fee; or

  • Leave without completing installation if the conditions cannot be resolved.

A refund will not be provided when setup cannot be completed because the client, venue, or designated contact failed to provide the required access.

8. Venue Requirements and Permissions

The client is responsible for:

  • Obtaining venue approval for balloon decor;

  • Confirming venue setup and removal times;

  • Confirming decor restrictions;

  • Providing accurate room and doorway measurements;

  • Confirming that the selected decor fits the intended location;

  • Confirming whether walls, doors, floors, or fixtures may be used;

  • Paying venue, parking, loading, security, or access charges; and

  • Communicating venue rules to Buoyant Bloom before the event.

Buoyant Bloom is not responsible for a venue’s refusal to allow the ordered decor or setup method.

If venue rules require a design or placement change, Buoyant Bloom may make reasonable modifications without providing a refund.

9. Design and Artistic Discretion

Each Buoyant Bloom piece is handmade. No two balloon arrangements will be exactly identical.

The client understands that:

  • Balloon sizes and shapes may vary slightly;

  • Arrangement and placement may vary;

  • Personalization positioning may vary;

  • Balloon finishes may affect the appearance of colors;

  • Structural or venue requirements may require design adjustments; and

  • Buoyant Bloom retains reasonable artistic discretion when assembling the design.

Product photographs, mockups, and inspiration images are examples only. They are not guarantees of an exact final arrangement.

Buoyant Bloom will not exactly reproduce another balloon artist’s work.

10. Balloon Colors and Substitutions

Clients may select up to four balloon colors unless the product listing provides a different limit.

Balloon colors may appear different because of:

  • Screen settings

  • Photography

  • Venue lighting

  • Natural lighting

  • Balloon finish

  • Inflation level

  • Manufacturer differences

  • Product availability

Exact digital color matching cannot be guaranteed.

If a selected balloon color, size, brand, or accessory becomes unavailable, Buoyant Bloom may substitute a reasonably similar option. Any substitution will be selected to preserve the general design and color palette as closely as possible.

A reasonable substitution does not qualify the order for a refund.

11. Personalization and Spelling

The client must enter names, ages, dates, phrases, punctuation, capitalization, and other wording exactly as they should appear.

Buoyant Bloom will create personalization using the information submitted with the order.

The client is responsible for reviewing all information before completing checkout. Buoyant Bloom is not responsible for:

  • Misspellings submitted by the client

  • Incorrect dates or ages

  • Incorrect capitalization

  • Missing punctuation

  • Incorrect logo names

  • Incomplete personalization instructions

Corrections requested after production has begun may require a replacement or redesign fee.

12. Logos and Client-Provided Materials

The client represents that they own or have obtained all permissions necessary for Buoyant Bloom to reproduce any logo, trademark, photograph, character, phrase, artwork, or other protected material submitted with the order.

The client accepts responsibility for claims resulting from materials they supplied without authorization.

Buoyant Bloom may decline to reproduce material that is unlawful, offensive, discriminatory, threatening, misleading, or reasonably believed to violate another party’s rights.

Logo colors and fine details may be simplified to accommodate balloon decor and vinyl-production limitations.

13. Intellectual Property

All intellectual property created by, owned by, or licensed to Buoyant Bloom remains the property of Buoyant Bloom or its applicable owner.

This may include, to the extent protected by applicable law:

  • The Buoyant Bloom business name, logo, slogan, and brand elements;

  • Website text, product descriptions, policies, pricing guides, and marketing materials;

  • Original photographs, videos, graphics, illustrations, and social-media content;

  • Product names, presentation materials, proposals, mockups, templates, and design plans; and

  • Original creative materials developed for an order.

Purchasing balloon decor does not transfer ownership of Buoyant Bloom’s intellectual property to the client.

The client may photograph and share their completed event decor for personal, noncommercial purposes. When reasonably possible, credit to Buoyant Bloom is appreciated but not required.

Unless Buoyant Bloom provides prior written permission, the client may not:

  • Copy or reproduce Buoyant Bloom photographs, mockups, graphics, website content, or written materials;

  • Remove or alter a watermark, logo, copyright notice, or attribution;

  • Use Buoyant Bloom materials to advertise another business;

  • Provide Buoyant Bloom mockups, templates, or design plans to another decorator for reproduction;

  • Sell, license, distribute, or commercially exploit Buoyant Bloom materials; or

  • Use the Buoyant Bloom name, logo, slogan, or branding in a way that suggests sponsorship, partnership, or endorsement.

Nothing in these Terms prevents a client from using photographs they personally own, subject to the rights of any photographer, venue, guest, or other third party.

The client retains any ownership rights they have in logos, photographs, wording, or other materials submitted with an order. By submitting those materials, the client grants Buoyant Bloom a limited, nonexclusive license to reproduce and modify them only as reasonably necessary to complete, deliver, document, and photograph the ordered decor.

Use of completed-project photographs remains subject to the Photography and Marketing section of these Terms.

14. Changes to an Order

All change requests must be submitted in writing.

Requested changes are subject to:

  • Scheduling availability

  • Material availability

  • Production status

  • Delivery availability

  • Additional payment

Changes are not guaranteed after an order has been accepted.

Color, personalization, logo, product, quantity, delivery, venue, and event-date changes may require additional charges.

Changes requested fewer than 14 calendar days before the event may be declined. Rush orders may not be eligible for changes after purchase.

Verbal discussions and social-media messages do not modify an order unless Buoyant Bloom confirms the change in writing.

15. Custom Orders and Final Sales

All Buoyant Bloom products are custom, perishable, and prepared for a specific client or event date.

For that reason:

  • All accepted orders are final sale;

  • Payments are non-refundable once the order has been accepted;

  • Personalized items cannot be returned or exchanged;

  • Unused balloons or accessories are not provided to the client; and

  • No refund is issued because the client no longer needs the decor, changes plans, reduces attendance, changes venues, or dislikes a color variation that falls within the selected palette.

Nothing in this section limits any rights that cannot legally be waived.

16. Cancellations

Cancellation requests must be submitted in writing.

Because materials, production time, and event capacity are reserved specifically for each order, payments are non-refundable after order acceptance.

A cancellation does not eliminate responsibility for unpaid approved charges, custom materials, completed work, delivery attempts, or damage to Buoyant Bloom property.

Failure to respond to messages, provide event details, grant venue access, or appear at the scheduled delivery does not constitute a cancellation by Buoyant Bloom and does not qualify for a refund.

17. Rescheduling

A client may request to reschedule an order by providing at least 14 calendar days’ written notice.

Rescheduling is:

  • Subject to Buoyant Bloom’s availability;

  • Limited to one reschedule per order;

  • Available only to the original client;

  • Valid for a new event date within 90 days of the original date; and

  • Subject to current delivery, product, and service pricing.

Payments may be transferred as store credit toward the rescheduled order at Buoyant Bloom’s discretion.

Materials that have already been personalized, inflated, assembled, specially ordered, or rendered unusable for the new event may need to be purchased again.

Requests made fewer than 14 calendar days before the event may be treated as cancellations.

Rush orders are not eligible for rescheduling unless approved in writing.

18. Weather and Outdoor Decor

Outdoor balloon decor is affected by environmental conditions and is accepted at the client’s risk.

Conditions that may damage or change balloons include:

  • Heat

  • Direct sunlight

  • Cold temperatures

  • Wind

  • Rain

  • Humidity

  • Rough surfaces

  • Grass

  • Trees

  • Brick

  • Concrete

  • Hot pavement

  • Sharp objects

Outdoor balloons may fade, oxidize, lose shine, shrink, expand, move, distort, or pop.

Buoyant Bloom does not guarantee how long outdoor balloon decor will last.

When conditions are unsafe or unsuitable, Buoyant Bloom may:

  • Move the setup indoors;

  • Relocate the decor;

  • Simplify or modify the arrangement;

  • Delay setup when reasonably possible; or

  • Decline outdoor installation.

The client should arrange an indoor backup location for all outdoor events.

A weather-related design modification does not qualify for a refund.

19. Severe Weather and Unsafe Conditions

Buoyant Bloom will not require its staff or equipment to operate in unsafe conditions.

Unsafe conditions may include:

  • Severe thunderstorms

  • Lightning

  • High winds

  • Flooding

  • Ice or snow

  • Dangerous road conditions

  • Excessive heat

  • Unsafe venue conditions

  • Civil emergencies

  • Restricted access

If delivery or setup cannot be performed safely, Buoyant Bloom will determine whether the order can reasonably be modified, delayed, moved indoors, rescheduled, or converted to credit.

Nonrecoverable expenses, custom materials, completed production, and third-party costs may be deducted from any available credit or refund.

20. Balloon Longevity

Balloon decor is temporary and perishable.

Buoyant Bloom guarantees only that the decor will be prepared with reasonable professional care and delivered in an acceptable condition at the scheduled time, subject to environmental and venue conditions.

No specific balloon lifespan is guaranteed after delivery or installation.

Indoor decor generally performs differently from outdoor decor, and individual balloons may deflate or pop unexpectedly.

No refund or repair is provided for damage occurring after setup because of:

  • Guests

  • Children

  • Pets

  • Venue staff

  • Moving or handling

  • Temperature changes

  • Weather

  • Sharp objects

  • Open flames

  • Heating or air-conditioning vents

  • Improper storage

  • Intentional damage

  • Accidental contact

21. Rental and Support Equipment

Unless expressly identified as a customer-owned item, all bases, frames, poles, stands, weights, hardware, covers, and support equipment remain the exclusive property of Buoyant Bloom.

Payment for balloon decor does not transfer ownership of this equipment.

The client agrees that rental and support equipment will not be:

  • Moved without permission;

  • Disassembled;

  • Altered;

  • Decorated by another vendor;

  • Removed from the venue;

  • Lent to another person;

  • Discarded;

  • Left outdoors after the event; or

  • Used for another purpose.

The client is responsible for the equipment from the completion of setup until Buoyant Bloom retrieves it.

22. Equipment Retrieval

The client must ensure that all Buoyant Bloom equipment is available and accessible at the agreed retrieval time.

The client must provide:

  • Accurate retrieval instructions

  • Venue access

  • An available contact when required

  • All originally delivered equipment

  • Safe and reasonable loading access

Additional fees may apply if:

  • The venue is inaccessible;

  • Equipment has been moved;

  • Equipment cannot be located;

  • The event runs beyond the agreed retrieval time;

  • Buoyant Bloom must make another trip;

  • Retrieval requires excessive waiting; or

  • Equipment is returned in an unusually dirty or damaged condition.

23. Lost, Damaged, or Discarded Equipment

The client is financially responsible for Buoyant Bloom equipment that is lost, stolen, damaged, altered, discarded, or unavailable at retrieval while under the client’s or venue’s control.

The client may be invoiced for:

  • Repair costs

  • Cleaning costs

  • Replacement costs

  • Shipping costs

  • Labor

  • Additional retrieval attempts

  • Lost business caused by unavailable equipment

Payment for damaged or missing equipment is due upon receipt of the invoice.

The client is responsible for communicating this policy to venue staff, event planners, family members, guests, and cleanup crews.

24. Movement After Setup

Balloon arches, columns, towers, photo frames, freestanding garlands, and rental-supported decor should remain where Buoyant Bloom places them.

Moving a completed piece may:

  • Damage the balloons;

  • Destabilize the structure;

  • Damage the venue;

  • Damage the support equipment; or

  • Create a safety hazard.

Buoyant Bloom is not responsible for damage or injury resulting from a client, guest, venue employee, or other vendor moving, altering, or dismantling the decor after setup.

25. Client and Venue Property

Buoyant Bloom will use reasonable care while delivering and installing decor.

The client must disclose delicate surfaces, restricted areas, historic materials, unstable structures, or venue rules before setup.

Buoyant Bloom is not responsible for preexisting damage or for damage caused by:

  • Undisclosed surface conditions;

  • Unstable venue fixtures;

  • Incorrect venue instructions;

  • Client-requested placement against professional advice;

  • Guests or venue staff moving the decor; or

  • Another vendor interfering with the installation.

26. Balloon Safety

Balloons and balloon accessories are decorations, not toys.

Uninflated latex balloons and broken balloon pieces can create a serious choking risk. Children must be supervised around balloon decor, and broken balloons should be discarded immediately. The U.S. Consumer Product Safety Commission specifically advises keeping balloons away from children younger than eight because of this risk.

The client agrees to:

  • Supervise children around balloons;

  • Keep uninflated and broken balloons away from children;

  • Keep balloons away from open flames and high heat;

  • Keep balloon strings and ribbons away from the neck;

  • Avoid inhaling helium;

  • Avoid releasing balloons outdoors;

  • Keep metallic balloons away from electrical lines; and

  • Inform Buoyant Bloom of known latex-allergy concerns before ordering.

Buoyant Bloom is not responsible for the misuse of balloons after delivery.

27. Allergies

Most balloon decor contains latex unless otherwise stated.

The client is responsible for determining whether the client, guests, venue staff, or event participants have latex or material sensitivities.

Buoyant Bloom must be notified of known allergy concerns before the order is accepted. Buoyant Bloom cannot guarantee a completely latex-free production, transportation, or installation environment.

28. Photography and Marketing

Buoyant Bloom may photograph or record completed decor for:

  • Portfolio use

  • Website content

  • Social media

  • Advertising

  • Printed marketing

  • Educational content

Whenever reasonably possible, photographs will focus on the balloon decor rather than identifiable guests.

Buoyant Bloom will not intentionally publish identifiable photographs of minors without permission.

A client who does not want the decor photographed or published must notify Buoyant Bloom in writing at least 48 hours before delivery.

Client-provided professional event photographs may not be used by Buoyant Bloom unless the client or photographer grants permission.

29. Third-Party Vendors and Venues

Buoyant Bloom is not responsible for the actions, delays, restrictions, cancellations, or failures of:

  • Venues

  • Event planners

  • Photographers

  • Caterers

  • Rental companies

  • Security personnel

  • Parking operators

  • Other decorators

  • Delivery services

  • Balloon manufacturers

  • Other third parties

The client remains responsible for coordinating the event and communicating relevant information between vendors.

30. Events Beyond Reasonable Control

Buoyant Bloom is not liable for delay or failure caused by circumstances beyond its reasonable control, including:

  • Severe weather

  • Natural disasters

  • Fire

  • Flooding

  • Government restrictions

  • Road closures

  • Civil disturbances

  • Utility outages

  • Supply shortages

  • Manufacturer defects

  • Transportation interruptions

  • Venue closures

  • Illness or medical emergencies

  • Vehicle accidents or unexpected mechanical failure

  • Other emergencies

When reasonably possible, Buoyant Bloom may offer a modification, substitute product, reschedule, credit, or partial refund based on the work already completed and expenses already incurred.

31. Cancellation by Buoyant Bloom

Buoyant Bloom may cancel an order if performance becomes impossible, unlawful, or unsafe.

If Buoyant Bloom cancels for reasons unrelated to the client’s actions and cannot provide a reasonable alternative, the client will receive a refund for the portion of the order that was not provided.

Buoyant Bloom’s responsibility will not exceed the amount paid for the affected order, except where applicable law requires otherwise.

32. Limitation of Liability

To the fullest extent permitted by law, Buoyant Bloom is not liable for indirect, incidental, special, punitive, or consequential losses arising from an order, including lost profits, lost business, emotional distress, venue expenses, or the cost of replacing unrelated event services.

To the fullest extent permitted by law, Buoyant Bloom’s total liability relating to an order will not exceed the amount the client paid directly to Buoyant Bloom for the affected product or service.

This limitation does not exclude liability that cannot legally be limited or excluded.

33. Indemnification

To the fullest extent permitted by law, the client agrees to defend and hold Buoyant Bloom harmless from third-party claims arising from:

  • Unauthorized logos or materials supplied by the client;

  • The client’s violation of venue rules;

  • Moving or altering the decor after setup;

  • Misuse of balloons or equipment;

  • Failure to supervise children;

  • Unsafe conditions controlled by the client or venue; or

  • The client’s violation of these Terms.

34. Billing Concerns and Payment Disputes

Questions regarding a payment or charge should be submitted to Buoyant Bloom promptly through the website Contact page.

The client agrees to provide Buoyant Bloom a reasonable opportunity to review and address a billing concern before initiating a payment dispute.

Nothing in these Terms limits any consumer right that cannot legally be waived.

35. Written Communications

All order changes, cancellations, rescheduling requests, venue updates, and disputes must be submitted in writing.

Messages sent through social media are not guaranteed to be reviewed in time to affect an order.

The client is responsible for monitoring the email address and telephone number provided during checkout.

36. Privacy

Personal information submitted through the website will be handled according to the Buoyant Bloom Privacy Policy.

Payment information may be processed by third-party payment providers. Buoyant Bloom does not control the privacy or security practices of independent payment processors or website-service providers.

37. Governing Law

These Terms & Conditions are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

Any legal proceeding relating to an order or these Terms must be brought in a court with proper jurisdiction in Davidson County, Tennessee, unless applicable law requires otherwise.

38. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

39. No Waiver

A failure by Buoyant Bloom to enforce any provision of these Terms does not waive the right to enforce that provision later.

40. Entire Agreement

These Terms, the applicable product listing, the order confirmation, and any written modifications confirmed by Buoyant Bloom constitute the entire agreement between Buoyant Bloom and the client for the order.

If these Terms conflict with a specific written agreement signed by both parties, the signed agreement will control.

41. Updates to These Terms

Buoyant Bloom may update these Terms & Conditions periodically.

The version in effect when an order is accepted will apply to that order. Updates will not retroactively change an already accepted order unless both parties agree in writing.
