You may not be able to unsubscribe from necessary order communications while an active order remains incomplete.
5. Marketing Communications
Buoyant Bloom may send promotional emails only when permitted by applicable law, such as when you:

Enter a promotion under terms that disclose marketing enrollment; or
Otherwise agree to receive marketing communications.
You may unsubscribe from marketing emails by selecting the unsubscribe link contained in the message.
Unsubscribing from marketing communications will not prevent us from sending necessary order, payment, delivery, account, or legal communications.
If Squarespace Email Campaigns or another marketing provider is used, your name, email address, subscription status, and engagement information may be processed by that provider to deliver and manage the communications.
6. Abandoned-Cart Emails
If abandoned-cart recovery is enabled, the website may send a reminder after you:
Enter an email address during checkout or sign in to a customer account;
Add an available product to your cart; and
Leave without completing the purchase.
The reminder may contain a link allowing you to return to your cart. You may unsubscribe from abandoned-cart messages through the link in the email.
Squarespace identifies abandoned-cart recovery as a feature that may use an email address entered at checkout or connected with a customer account.

If customer accounts are enabled, we may collect and store information needed to operate your account and simplify checkout, including:

Squarespace states that Squarespace Payments uses Stripe for payment processing and Sift for fraud monitoring and detection. This provision should remain only if Squarespace Payments is your actual payment solution.

12. Personalization, Logos, and Uploaded Images

Providing a logo, photograph, or inspiration image does not automatically give Buoyant Bloom permission to publish that material for marketing.
However, photographs taken by Buoyant Bloom of completed décor may be used in accordance with the Photography and Marketing section of our Terms & Conditions.
Please avoid submitting images containing sensitive information, private documents, financial information, or individuals who have not agreed to the submission.
13. Event Photography
Buoyant Bloom may photograph or record completed balloon décor for:
Portfolio use;
Website content;
Social media;
Printed marketing;
Advertising; and
Business documentation.
We generally intend to focus on the completed décor rather than identifiable guests.
We will not knowingly publish an identifiable image of a minor without appropriate permission.
A customer who does not want completed décor photographed or published must notify Buoyant Bloom in writing at least 48 hours before delivery, as stated in the Terms & Conditions.
Client-submitted professional photographs will not be published unless Buoyant Bloom has permission from the client and, where required, the photographer or rights holder.
14. Children’s Information
The Buoyant Bloom website and services are intended for adults who are legally able to place an order.
The website is not directed to children younger than 13, and Buoyant Bloom does not knowingly collect personal information directly from children younger than 13.
A parent or legal guardian may provide limited information about a child, such as a first name or age, when ordering personalized décor. That information will be used only as reasonably necessary to fulfill and document the order.
Customers should not submit:
A child’s full legal name unless necessary;
School records;
Medical information;
Home-address information relating specifically to a child;
Identification documents; or
Other sensitive information about a child.
If you believe a child submitted information directly to us without appropriate permission, contact us so the information can be reviewed and, where appropriate, deleted.

A delivery or venue address is collected only as needed to provide the requested service and coordinate equipment retrieval.
16. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy.
Retention may depend on:
Whether an order remains active;
Whether equipment has been retrieved;
Tax and accounting requirements;
Chargeback and payment-dispute periods;
Legal limitation periods;
Insurance requirements;
Customer-service needs;
Contract-enforcement needs;

Whether you remain subscribed to marketing communications.
Order, transaction, payment-status, and business records may be retained for the period reasonably necessary to meet tax, accounting, legal, and insurance obligations.
Marketing information may be retained until you unsubscribe or request deletion, subject to retaining limited suppression records needed to honor an unsubscribe request.
Uploaded files and personalization information may be deleted when they are no longer needed, but copies may remain temporarily in backups or business records.
The FTC recommends collecting only information a business needs, retaining it only while a legitimate need exists, and disposing of it securely afterward.

You are not required to create a new customer account solely to submit a privacy request.
Where applicable law establishes a response deadline, Buoyant Bloom will respond within that period. Under TIPA, a covered controller generally must respond within 45 days, subject to one permitted 45-day extension when reasonably necessary.
20. Appeals
If applicable law grants you the right to appeal a denied privacy request, submit the appeal through the Contact page using the subject line:

Where TIPA applies, an appeal process must be available without charge, and the controller generally must issue a written appeal response within 60 days.

Exercising a privacy right will not result in:

Buoyant Bloom is based in Tennessee, United States.
Squarespace and other service providers may process or store information in the United States or in other locations where they or their service providers operate.
By using the website or submitting information, you understand that your information may be processed outside your state, province, or country, subject to applicable legal safeguards.
